1. Who We Are

Cluzy ("we," "our," or "us") operates the Cluzy — AI Thrift Scanner & Resale Profit Finder mobile application (the "App") and the website at cluzy.app (the "Website," and together with the App, the "Services"). We are the data controller of the personal information described in this policy.

This Privacy Policy explains what information we collect, why we collect it, how we use and share it, how long we keep it, and the choices and rights you have. 2. Information We Collect

2.1 Information You Provide to Us

  • Account information: your name, email address, and profile details when you create an account.
  • Purchase information: if you subscribe to premium features, payment is processed entirely by Apple (App Store) or Google (Play Store). We receive confirmation of your subscription status but never collect or store your payment card details.
  • User content: photos and images you scan with the App for item identification and pricing.
  • Communications: information you provide when you contact support, respond to surveys, or suggest features.

2.2 Information Collected Automatically

  • Device information: device model, operating system and version, app version, language, and unique device identifiers.
  • Usage data: features used, scan history, screens viewed, session duration, and in-app interactions.
  • Diagnostic data: crash logs and performance data used to keep the App stable.
  • Website analytics: we use privacy-focused analytics (Vercel Analytics) on the Website to collect aggregated, anonymous usage statistics. These do not use cross-site tracking cookies.

2.3 Information from Other Sources

  • Marketplace data: we aggregate publicly available sold-listing data from marketplaces such as eBay, Poshmark, Depop, and Mercari to produce pricing estimates. We do not access your personal accounts on those platforms unless you explicitly connect one (for example, linking your eBay account to create listings).
  • App store data: Apple and Google provide us with aggregated download, subscription, and crash statistics for the App.

2.4 Camera and Photo Permissions

The App requests access to your camera and photo library so you can scan items. Photos are used only to identify items and generate listings. You can revoke these permissions at any time in your device settings; the scanning features will stop working, but the rest of the App will remain usable.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Services and their features
  • Process item scans and deliver pricing estimates, profit calculations, and resale insights
  • Generate marketplace listings (for example, eBay listings) when you use the listing feature
  • Create and manage your account and subscription
  • Send technical notices, security alerts, and support responses
  • Understand how the Services are used so we can improve them
  • Detect, prevent, and address fraud, abuse, and technical issues
  • Comply with legal obligations

We do not use your photos to build advertising profiles, and we do not sell your personal information to anyone.

Where the EU or UK General Data Protection Regulation (GDPR) applies, we process your personal data on these legal bases:

  • Performance of a contract: to provide the Services you signed up for (account management, scanning, pricing, listings).
  • Legitimate interests: to keep the Services secure, prevent fraud, and improve features — balanced against your rights and freedoms.

5. How We Share Your Information

We do not sell your personal information. We share information only in the circumstances below:

5.1 Platform Partners (Apple and Google)

If you use the iOS version of the App, we share usage data with Apple. If you use the Android version of the App, we share usage data with Google. This includes app interaction events, session and diagnostic data, and subscription status. This sharing supports app distribution, in-app purchase and subscription management, analytics, and crash reporting on each platform. Apple's handling of this data is governed by the Apple Privacy Policy, and Google's by the Google Privacy Policy.

5.2 Service Providers

We use a small number of vetted third-party providers who process data on our behalf and only on our instructions, for: cloud hosting and storage, AI image-recognition processing, website analytics, and customer support tooling. Each provider is bound by contractual confidentiality and data-protection obligations.

5.3 Marketplaces You Connect

If you connect a marketplace account (for example, eBay) to create listings, we share the listing content you ask us to publish with that marketplace. That marketplace's own privacy policy then applies to the data it receives.

5.4 Legal, Safety, and Business Transfers

  • Legal requirements: we may disclose information if required by law, regulation, subpoena, or other legal process, or to protect the rights, property, or safety of Cluzy, our users, or the public.
  • Business transfers: if we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or in how your information is handled.
  • With your consent: we may share information for other purposes when you explicitly agree.

6. Cookies & Analytics

The Website uses only essential cookies and privacy-focused, cookieless analytics (Vercel Analytics) that measure aggregate page views without identifying individual visitors or tracking you across other sites. We do not use third-party advertising cookies on the Website. The App does not use cookies; in-app analytics are described in Sections 2.2 and 5.1.

7. Data Retention

  • Account data: kept while your account is active, and deleted within 30 days after you delete your account or ask us to.
  • Scan history and saved items: kept in your account until you delete them or delete your account.
  • Support communications: kept for up to 24 months to help resolve follow-up issues.
  • Diagnostic and analytics data: kept in identifiable form only as long as needed, then aggregated or anonymized.

We may retain certain information for longer where required by law (for example, records related to payments or fraud prevention). When data is no longer needed, we securely delete or anonymize it.

8. Data Security

We protect your information with technical and organizational measures that include encryption in transit (TLS), encryption at rest for stored data, access controls limiting who at Cluzy can view personal data, and regular review of our providers' security practices. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security — but if we learn of a breach affecting your personal data, we will notify you and the relevant authorities as required by law.

9. International Data Transfers

Our Services are operated from, and our providers store data in, the United States and other countries that may have data-protection laws different from those in your country. Where we transfer personal data from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards such as Standard Contractual Clauses and transfers to providers certified under recognized data-transfer frameworks.

10. Your Privacy Rights

Wherever you live, we offer you the following controls:

  • Access and update: view and edit your account information in the App settings.
  • Deletion: delete your account and associated data in the App settings, or by emailing support@cluzy.app.
  • Portability: request a copy of your data in a portable format.
  • Correction: ask us to correct inaccurate personal data.
  • Objection and restriction: object to or ask us to restrict certain processing.
  • Withdraw consent: revoke camera/photo permissions in device settings, or unsubscribe from marketing emails at any time.
  • Manage subscriptions: manage or cancel through your App Store or Google Play account settings.

We respond to verified requests within 30 days. If you are in the EEA or UK and believe we have not resolved your concern, you have the right to lodge a complaint with your local data-protection authority. We will never discriminate against you for exercising any privacy right.

11. Additional Rights for US Residents

If you live in California or another US state with a comprehensive privacy law (including the CCPA/CPRA), you additionally have the right to know the categories of personal information we collect and share, the right to delete, the right to correct, and the right to opt out of the "sale" or "sharing" of personal information. We do not sell or share your personal information as those terms are defined under the CCPA/CPRA, and we do not use or disclose sensitive personal information for purposes requiring a right to limit. To exercise any right, email support@cluzy.app with the subject line "Privacy Request." An authorized agent may submit a request on your behalf with proof of authorization.

12. Children's Privacy

The Services are not directed at children under 13 (or the higher minimum age required in your country), and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us at support@cluzy.app and we will promptly delete it.

The Services may link to third-party websites and services (for example, eBay, Poshmark, Depop, Mercari). We are not responsible for the privacy practices of those third parties, and this policy does not apply to them. We encourage you to review their privacy policies before providing them any information.

14. Changes to This Policy

We review this policy regularly and may update it as our Services or the law change. When we make material changes, we will notify you in the App or by email before the changes take effect, and we will always update the "Last updated" date at the top of this page. Your continued use of the Services after changes take effect constitutes acceptance of the updated policy.
